Personal Body Terms of Service
Article 1 (Purpose)
These Terms set out the rights, obligations, responsibilities, and other necessary matters between 사공사랩스 (the "Company") and users in connection with the AI body analysis service and related services provided by the Company.
Article 2 (Definitions)
The terms used in these Terms have the following meanings.
1."Service" means the Company's AI-based body measurement, 3D modeling, body-shape analysis, and related services, regardless of the device used.
2."User" means a member or non-member who uses the Service under these Terms.
3."Member" means a person who registers by providing personal information to the Company and can continuously receive Company information and use the Service.
4."Non-member" means a person who uses the Service without registering as a member.
5."Content" means all text, photos, videos, attachments, links, and similar materials posted on the Service by the Company or users.
6."Body Data" means front, side, and back photos uploaded by a member to use the Service, as well as anatomical landmarks, measurements, 3D mesh, body-shape classification results, and related outputs analyzed by AI from those photos.
Article 3 (Matters Not Specified)
Matters not specified in these Terms are governed by applicable laws, including the Telecommunications Business Act, consumer protection laws for e-commerce, personal information protection laws, and customary practice.
Article 4 (Effect and Amendment of Terms)
1.These Terms apply to all users who wish to use the Service.
2.The Company may amend these Terms when necessary, within the scope permitted by applicable laws.
3.If the Company amends these Terms, it will announce the effective date and reason for amendment together with the current Terms in the Service from 7 days before the effective date until the day before the effective date. If an amendment is unfavorable to users, the Company will announce it at least 30 days in advance.
4.A user who does not agree to amended Terms may stop using the Service and request account withdrawal. Continued use of the Service after the effective date is deemed acceptance of the amended Terms.
Article 5 (Formation of Use Agreement)
1.A use agreement is formed when a user agrees to these Terms, enters member information according to the Company's registration form, applies for registration, and the Company accepts the application.
2.The Company may refuse acceptance or terminate the use agreement afterward in the following cases.
1.False information, lack of required guardian consent for a minor, improper use, failed identity verification, prior violation history, or similar grounds.
2.Any other case where the Company's application requirements are not satisfied.
Article 6 (Changes to Member Information)
1.A member may view and edit personal information at any time through the personal information management screen.
2.If information entered at registration changes, the member must update it online or notify the Company by email or other means.
3.The Company is not responsible for disadvantages caused by a member's failure to notify changes under the preceding paragraph.
Article 7 (Collection, Use, and Protection of Personal Information and Body Data)
1.The Company works to protect members' personal information in accordance with applicable laws. The Company's privacy policy and applicable laws apply to protection and use of personal information.
2.[Use and Storage for AI Training] To provide more precise services and improve the quality of the Company's own AI models and generative AI development, the Company may securely store and use Body Data, including original photos uploaded by users.
3.[Safety and Pseudonymization] When storing and using data for the purpose stated in paragraph 2, the Company immediately de-identifies information that can identify an individual, such as a member's face, through masking, cropping, or similar methods, and pseudonymizes the data in accordance with personal information protection guidelines. Pseudonymized data is managed separately from member account information.
4.[Withdrawal and Destruction] A user may refuse or withdraw consent for use of the user's data in AI model training at any time. In that case, the Company will promptly destroy the original data. However, destruction may not be possible for data that has already been anonymized and incorporated into AI neural network weights or similar forms. Details follow the Privacy Policy.
Article 8 (Member Account Management)
1.A member is responsible for managing social account login information, including KakaoTalk, and must not allow a third party to use it.
2.The Company may restrict use of an account if there is a risk of personal information leakage, if the account is contrary to public order or morals, or if it may be mistaken for the Company.
3.If a member becomes aware that the account has been misused or is being used by a third party, the member must promptly notify the Company and follow the Company's guidance.
4.The Company is not responsible for disadvantages caused by a member's failure to notify the Company or follow its guidance under the preceding paragraph.
Article 9 (User Obligations)
1.A user must not engage in the following acts.
1.Registering false information when applying or changing information.
2.Misusing another person's information.
3.Uploading a third party's photo, including body images, without that person's consent.
4.Altering information posted by the Company.
5.Transmitting or posting information, including computer programs, other than information permitted by the Company.
6.Infringing intellectual property rights, including copyrights of the Company or third parties.
7.Damaging the reputation of or interfering with the business of the Company or third parties.
8.Uploading obscene, violent, or otherwise publicly inappropriate body images.
9.Any other illegal or improper act.
2.Users must comply with applicable laws, these Terms, user guides, Service-related notices, and matters notified by the Company.
Article 10 (Provision and Change of Service)
1.The Company provides the following services.
1.Background segmentation and image processing through user photo uploads.
2.AI-based 3D body modeling and body measurement.
3.Body-shape classification and reports based on measured data.
4.Storage of user body records and history review services.
2.The Company may change services for operational or technical reasons when there is a reasonable cause.
3.In principle, the Company provides the Service 24 hours a day, year-round, unless there are operational or technical issues.
Article 11 (Service Suspension)
1.The Company may temporarily suspend the Service for maintenance of information and communications facilities, communication interruption, or similar reasons.
2.The Company is not liable for damages caused by a Service suspension under paragraph 1 unless there is intent or gross negligence.
Article 12 (Withdrawal and Loss of Membership)
1.A member may request withdrawal at any time through settings or similar menus, and the Company will process the withdrawal promptly.
2.Upon withdrawal, all Body Data and analysis results of the member will be deleted without delay, except for information the Company must retain under applicable laws.
3.If a member violates Article 9 (User Obligations), the Company may restrict, suspend, or terminate membership.
Article 13 (Management and Copyright of Posts)
1.If a member's post, excluding photos, violates laws or these Terms, the Company may delete it or take temporary measures without prior notice.
2.Copyrights to general posts made by a member in the Service, excluding Body Data, belong to the member, and the Company may use them within the purpose of operating the Service.
Article 14 (Paid Services, Payment, and Refunds)
1.The Company may provide paid services, and details regarding payment and refunds follow these Terms and separate policies.
2.If a payment issue occurs due to a Company system error, a full refund is the principle. Refunds due to a member's simple change of mind follow applicable laws and Company rules.
Article 15 (Limitation of Liability and Disclaimer)
1.The Company is exempt from liability for providing the Service when it cannot provide the Service due to natural disasters or force majeure.
2.Body measurements and body-shape analysis results provided by the Company are estimates generated through AI algorithms and may differ from actual measured values, for example by an average error range of around 3 cm. The Company does not guarantee complete accuracy.
3.The Company is not commercially or medically responsible for decisions users make based on analysis results, such as selecting a clothing size or making diet-related or other medical judgments.
4.The Company is not responsible for Service disruptions caused by a member's fault or legal disputes arising from unauthorized use of another person's photos.
Article 16 (Governing Law and Jurisdiction)
1.Lawsuits between the Company and members are governed by the laws of the Republic of Korea.
2.Lawsuits concerning disputes between the Company and members are brought before the competent court under the Civil Procedure Act.
